1. Purpose
These terms define the rules for access to and use of the platform. By using the service, you accept these terms.
2. User account
You are responsible for the information provided during registration and for keeping your credentials confidential. You must take reasonable measures to protect your account (strong password, no credential sharing, device security). Any activity performed from your account is deemed to be under your responsibility. If you suspect or detect unauthorized access, you must notify us without delay at contact@bytheprompt.com. Account sharing is prohibited unless expressly authorized under a specific offering.
3. Acceptable use
You agree to use the service in compliance with applicable laws and not to misuse the platform, including fraudulent, malicious use, or use that infringes third-party rights.
4. Intellectual property
Service elements (trademarks, interface, content, code, documentation) are protected by intellectual property rights. Any unauthorized reproduction or exploitation is prohibited. AI-generated content produced from prompts you create remains your exclusive property, subject to third-party rights, applicable model-provider terms, and applicable law.
5. Availability and changes
We strive to ensure service availability, without guaranteeing uninterrupted operation. Interruptions may occur due to planned maintenance, security incidents, technical failures, or third-party provider outages (including hosting, OpenRouter, Stripe). The platform may change at any time (features, pricing, technical limits). Unless stated otherwise, subscriptions are billed in advance for the selected billing cycle and automatically renew until canceled. You may cancel renewal at any time for the next period. Unless mandatory law or an explicit statement provides otherwise, fees paid are non-refundable for the current period.
6. Limitation of liability
To the extent permitted by law, we shall not be liable for indirect damages, loss of business, loss of profits, loss of revenue, reputational harm, loss of opportunity, or data loss resulting from use of the service. Subject to mandatory applicable rules, our total aggregate liability, on any grounds, is capped at the amount paid by the user during the 12 months preceding the triggering event.
7. Termination
We may suspend or terminate access in case of non-compliance with these terms. You may stop using the service at any time.
8. Changes to terms
These terms may be updated. The version in force is the one published on this page on the indicated date.
9. Governing law and jurisdiction
The service is provided from Québec (Canada), although it is accessible from other countries. These terms are governed by the applicable laws of Québec and Canada. Subject to mandatory rules applicable in your place of residence, any dispute relating to the service falls under the jurisdiction of the competent courts of Québec, in the judicial district corresponding to ByThePrompt's registered office (Lac-Mégantic).
